Terms and Conditions
Please read these terms carefully before using our services
1. Definitions
1.1 “Contractor” refers to U-Guard Fencing, a division of U-Guard SA (Pty) Ltd.
1.2 “Client” refers to the individual or entity requesting services.
1.3 “Works” refers to all fencing, gate installation, repair, or related services agreed upon.
1. Quotations and Acceptance
2.1 All quotations are valid for a period of 14 days unless otherwise stated.
2.2 Acceptance of a quotation, whether written or verbal, constitutes agreement to these Terms and Conditions.
2.3 Any changes to the scope of work may result in a revised quotation.
3. Payment Terms
3.1 A deposit of 70% is required before work commences, unless the client has an approved Credit Facility with U-Guard SA (Pty) Ltd
3.2 Progress payments will be required for larger projects.
3.3 Final payment is due upon completion of the Works.
3.4 Late payments may incur interest or penalties as permitted by law.
4. Scope of Work
4.1 The Contractor agrees to carry out the Works as specified in the quotation.
4.2 Any additional work requested by the Client will be charged separately.
4.3 The Contractor reserves the right to refuse work outside the agreed scope.
5. Materials
5.1 Materials will be supplied as specified in the quotation.
5.2 Substitutions may be made if materials are unavailable, subject to Client approval.
5.3 The Contractor is not responsible for manufacturer defects but will assist with warranty claims where possible.
6. Site Conditions
6.1 The Client must ensure clear and safe access to the work site.
6.2 The Contractor is not responsible for delays or additional costs caused by:
* Hidden underground services (pipes, cables, etc.)
* Unstable soil or terrain
* Obstructions not disclosed prior to work
6.3 Any additional work required due to unforeseen site conditions will be quoted separately.
7. Permits and Approvals
7.1 The Client is responsible for obtaining any required permits, approvals, or permissions unless otherwise agreed in writing.
7.2 The Contractor will comply with applicable building regulations where required.
*8. Timeframes*
8.1 Estimated start and completion dates are subject to change due to weather, material availability, or unforeseen circumstances.
8.2 The Contractor will make reasonable efforts to meet agreed timelines but does not guarantee completion dates.
*9. Workmanship Warranty*
9.1 The Contractor provides a workmanship warranty 12 months from the date of completion.
9.2 This warranty does not cover:
* Normal wear and tear
* Damage caused by misuse, accidents, or third parties
* Environmental factors (e.g., extreme weather, corrosion in coastal areas)
*10. Liability*
10.1 The Contractor is not liable for indirect, incidental, or consequential damages.
10.2 Liability is limited to the value of the contract unless otherwise required by law.
10.3 The Client is responsible for ensuring property boundaries are correctly identified.
*11. Cancellations and Refunds*
11.1 The Client may cancel the contract in writing; however, deposits may be non-refundable once work has commenced or materials have been ordered.
11.2 The Contractor may cancel due to non-payment or unsafe working conditions.
*12. Ownership and Risk*
12.1 Ownership of materials remains with the Contractor until full payment is received.
12.2 Risk passes to the Client upon installation or delivery.
*13. Dispute Resolution*
13.1 Any disputes should first be addressed through negotiation between the parties.
13.2 If unresolved, disputes may be referred to mediation or arbitration in accordance with applicable laws.
*14. Force Majeure*
14.1 The Contractor shall not be liable for delays or failure to perform due to events beyond reasonable control, including natural disasters, strikes, or supply disruptions.
*15. General*
15.1 These Terms and Conditions constitute the entire agreement between the parties.
15.2 Any amendments must be made in writing and signed by both parties.
15.3 If any provision is found invalid, the remaining provisions remain in effect.
